TERMS AND CONDITIONS
This document outlines what My-Traveling-Soul, LLC agrees to provide when you register for an excursion, and what you agree to do in return. This information is very important, please read it carefully.
Included in the price of the excursion:
My-Traveling-Soul ambassador on site 24/7 for quality assurance, guidance, support and assistance with unexpected events.
all accommodations per itinerary
all transportation during included group activities, as per itinerary
transfers between the airport and the hotel on arrival and between the hotel and the airport on departure,
all meals as per itinerary (non-alcoholic beverages and select wines are included)
all included group activities and side excursions, as per itinerary
all sightseeing, fees, and admissions, as per itinerary
All quoted prices include the cost of the excursion planning and operation. Excursion prices DO NOT INCLUDE: airfares, airport taxes, laundry charges, telephone calls, bar charges, items of personal nature, travel accident insurance, lost baggage, health or life insurance, tips for guides and/or drivers, private excursions, recreational activities not mentioned in the itinerary, optional activities, passport and/or visa when applicable. In the case of computer or human billing errors, we reserve the right to re-invoice Guests with correct billing.
ADDITIONAL EXPENSES INCURRED AS A RESULT OF DELAY, CHANGE OF SCHEDULES, ILLNESS, WEATHER, STRIKES, HOSTILITIES, QUARANTINE, GOVERNMENT REQUISITION OF HOTEL SPACE, OR ANY OTHER REASONS BEYOND THE CONTROL OF MY-TRAVELING-SOUL, LLC, SHALL ALL BE BORNE BY THE GUEST.
Prices do not include airfare.
Single supplements are available on a limited basis at additional cost. The actual cost of a single supplement for each excursion is available via a phone interview with the company ambassador.
Roommates: If any Guest wants to pay for the excursion at the shared-room price, yet does not have a specific roommate, the Excursion Ambassadors will attempt to match that Guest with a roommate. If the Excursion Ambassadors match the Guest with a roommate whom the Guest deems unsuitable, then the Guest must arrange for and pay for another room for herself, if another room is available. There will be no refunds for complaints about roommates, and if any Guest cancels the excursion because of a roommate, there will be no refunds.
Baggage: We recommend that Guests take along one bag/suitcase per person, plus a small carry-on bag. Due to a limited van/bus capacity, we request that only one bag per person be carried on vans. Baggage is carried at the owner's risk and baggage protection insurance is strongly recommended. Feel free to contact your Ambassador of specific packing suggestions for your excursion. Health: Excursions include a lot of walking, including walking on uneven surfaces, stairs, hiking, and standing while sightseeing. All Guests should be prepared to walk on uneven surfaces, including steps, during days when excursions are scheduled. If you have any concerns regarding your physical ability to participate in the excursion, we strongly recommend that you consult your physician before signing up for a journey. Any pre-existing physical, mental, or emotional disability that may require attention or treatment must be reported in writing prior to the beginning of our excursion. Guests who require any form of assistance must be accompanied by a helper who is capable of and totally responsible for providing such assistance. The group's itinerary will not be adjusted for people who are not able to keep up with the rest of the group. All Guests are required to complete and sign a Medical Release and Waiver Agreement. The minimum age for guests is 16. There is no maximum age; however, you must be able to keep up with the pace of the group. Children under the age of 18 must room with and be accompanied by a parent or guardian (documentation permitting a minor to travel with the parent or guardian is required). Smokers may smoke only outdoors and downwind from the group - never inside, in their rooms, vans or during group meals/activities. Smokers will stay in a single room unless they share a room with another smoker.
Travel Protection Insurance is not included in the excursion price. MY-TRAVELING-SOUL LLC, highly recommends obtaining individual travel protection for the duration of the excursion (trip cancellation, foreign medical, flight delays and cancellations, baggage, medical evacuation). Personal Accidents and Medical Emergency: In the event of an accident or medical emergency during the excursion, the guest is responsible for any cost incurred and related to such emergency. My-Traveling Soul lead ambassador will be available to provide support and assistance to the client until any medical situation can be addressed.
Travel documents and Visas: Guests are required to have a valid passport and if necessary, a visa. Incomplete documentation will result in the airline and airport authorities refusing permission to enter the country. The Excursion Ambassadors will not arrange for passports or visas and will not be held liable for any irregularities caused due to improper documentation. Each Guest is responsible for determining specific passport and visa requirements in the Guest's country of origin and for obtaining the necessary documents prior to their departure. (My-Traveling-Soul will provide information needed for the entry country documentation, prior to the departure of the excursion). Passport must be valid for at least 6 months beyond the anticipated excursion end date. It is suggested that all Guests check with the appropriate Consulate regarding their visa requirements.
Excursion itineraries are subject to change: Due to unexpected circumstances, we reserve the right to cancel, change or substitute an activity or a service. During local or national holidays abroad, certain facilities such as museums, sightseeing excursions, and shopping may be limited. Uncompleted portions of the excursion itinerary are not cause for a refund.
Waiver of responsibility: My-Traveling-Soul, LLC and its representatives ("Excursion Ambassadors") are making all ground arrangements pertaining to the Excursion, including, but not limited to, hotel and restaurant reservations, sightseeing and side trips, subject to the condition that the Excursion Ambassadors will not be held liable to injury, death, delay, theft, damage, or irregularities, however caused. Excursion Ambassadors will take no responsibility or liability for: 1. injury, loss, or damage to persons or property, including luggage. 2. additional expenses resulting from changes in exchange rates, tariffs, or schedule. 3. the act or default of any company or person engaged in conveying the Guests, or in carrying out the arrangements of the Excursion, or otherwise. 4. additional expenses incurred or due to sudden sickness, weather conditions, strikes, or other causes or acts of God. 5. losses due to cancellations.
Travel: Guests are responsible for their own travel arrangements to and from the guests' home to the airport. Please note that some excursions start and end in different cities and a "multiple city" air ticket is required. Ambassadors are available to answer questions regarding departure/destination airports.
Excursion Payments: To reserve space on any MY-TRAVELING-SOUL LLC excursion, a deposit of $600 per person, per excursion, is required at the time of booking. No reservation is considered confirmed until the deposit is received by MY-TRAVELING-SOUL and a formal interview has been conducted by a My-Traveling-Soul LLC ambassador. My-Traveling-Soul LLC retains the right to decline enrollment into an excursion after review of the registration application and personal interview with potential guests. If a guest is declined enrollment, the full deposit less a $75 application fee will be refunded within 7-10 business days of the ambassadors' decision.
The deposit is part of the final payment which must reach MY-TRAVELING-SOUL no later than 90 days prior to the start of the excursion. Returned checks will incur a fee of $35. For all deposits and excursion payments, we accept personal checks, credit cards, money orders, and bank drafts. Credit card payments incur a processing fee of 3.5% of the total amount paid with the credit card. We cannot accept debit cards for any excursion payments. Final excursion payments received later than one business day past the deadline will incur a late fee of $35. Missing the final payment deadline by later than seven business days may result in being removed from the excursion.
Cancellations and refunds: The excursion deposits are not refundable. Any amount paid outside of the deposit will be fully refunded by check minus a $200 administration fee if cancellation is made prior to 90 days of the excursion departure. Cancellations made within 90days of the excursion are not refundable. All cancellations must be sent to My-Traveling-Soul, LLC in writing: via mail to My-Traveling-Soul LLC, 130 Gardeners Circle #609, Freshfields Village, Johns Island, SC 29455 and will be effective on the date they are received by MY-TRAVELING-SOUL LLC. All cancellations must have the canceling party’s actual signature.
Excursion Cancellation by MY-TRAVELING-SOUL: Although we do our best to avoid this, it may occasionally become necessary for My-Traveling-Soul LLC to cancel an excursion due to insufficient registrations or any other cause. If an excursion is canceled due to low enrollment, you will be notified at least 60 days in advance. In this case, your entire payment will be refunded to you within fourteen days after the excursion cancellation, as required by the state of South Carolina. A refund of payments made constitutes full settlement and releases My-Traveling-Soul, LLC from any further liability. MY-TRAVELING-SOUL is not responsible for any additional expenses incurred by excursion members preparing for a canceled excursion, such as nonrefundable airline tickets or passport fees. In the unlikely event of an excursion cancellation, you will receive a $100 gift certificate valid towards another excursion within 18 months of the excursion cancellation. If an excursion is cancelled due to a natural disaster, strike, or other event outside our control, we cannot guarantee the 60 days’ notice, but you will receive a full refund of all payments made.
MY-TRAVELING-SOUL LLC strongly encourages all Guests to purchase Travel Insurance to cover additional costs (airline tickets, loss of luggage, trip delay or excursion cancellation, personal accident, medical evacuation, etc.). MY-TRAVELING-SOUL LLC assumes no liability for the safety of any Guest while in transit or during the excursion. Prior to participating in the travel activities, all Guests will be required to sign a Medical Release and Release of Liability for My-Traveling-Soul LLC.
MY-TRAVELING-SOUL LLC is not responsible or liable for loss, damage or theft of luggage or personal injury, accidents or illness while on excursion nor is MY-TRAVELING-SOUL LLC responsible for any type of trip interruption.
Notice to EU Individuals: this Privacy Statement and its enumerated policies are intended to comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the “General Data Protection Regulation” or “GDPR”) and provide appropriate protection and care with respect to the treatment of your user information in accordance with the GDPR.
Photographs: Representatives of the Excursion Ambassadors may be photographing the Excursion. The Excursion Ambassadors reserve the right to publish any such photographs without obtaining further consent from any Guest. Each Guest releases the Excursion Ambassadors and its representatives from any liability in connection with any such use of such photographs.
Leaving the excursion: The Excursion Ambassadors reserve the right to accept, decline, or retain any person as a Guest at the Excursion at any time without liability and without any obligation to pay a refund or any other amount whatsoever. The Excursion Ambassadors take no responsibility or liability for any Guest who leaves the Excursion prior to its conclusion or for any activity undertaken by any Guest that is not included on the Excursion itinerary. There will be no discounts or refunds for any Guest who temporarily leaves the Excursion and then returns to the Excursion later.
Special Requests: We will diligently attempt to meet any special requests of Guests, provided we receive the request at the time of booking. However, we cannot guarantee all requests.
Payment of deposit or full payment shall be deemed as consent by the Guest to the above Terms and Conditions.
PERSONAL RESPONSIBILITY: I am entirely responsible for my own personal safety, health, and mental, physical, emotional, and general well-being during and after the Excursion. I release My-Traveling-Soul, LLC and its representatives and any of their employees, assistants, and affiliates of any liability for any injuries or damages mentally or physically I or any of my family members might incur during or after the Excursion. I understand that no health insurance or travel insurance will be provided by the Excursion Ambassadors, and, if I wish to be insured, I must do this myself.
